This Privacy Policy applies to the use of the website helx.net, including all its translated versions ("our website").

2. Collection of Personal Data When Visiting Our Website

When you browse our website, we collect the following data, which is technically necessary for us to display the site to you and to ensure its stability and security. The legal basis for this is our legitimate interest, in accordance with Art. 6 (1) (f) GDPR.

The data collected includes:

  • Time zone difference to Greenwich Mean Time (GMT),

  • Access status/HTTP status code,
  • Amount of data transferred,
  • The website from which the request originates,

We collect and use the personal data we obtain through your use of our internet services only within the legally permissible framework and solely for the purpose for which you provided it (e.g., requesting informational materials, submitting comments, subscribing to newsletters, registering for the DMG Expert Lounge). The data collected is subject to extensive security measures designed to prevent unauthorized access, stop misuse, and protect against destruction or loss. 3. Contacting Us via E-mail or Our Contact Form

When you get in touch with us via e-mail or a contact form on this website, the data you provide (your e-mail address, and, if applicable, your name, phone number, and the content of your message) will be stored by us to answer your questions. Your data is processed as part of pre-contractual measures or based on your explicit consent, in accordance with Art. 6 (1) (a) and (b) GDPR. We will delete the data collected in this context once storage is no longer necessary, or we will restrict its processing if legal retention periods apply. When you contact us through our website, we collect the following data:

  • IP address of the destination e-mail server
  • Date and time of the request
  • Sender's e-mail address
  • Content of the request

Should you send us an e-mail with confidential content, we strongly recommend that you encrypt it to prevent unauthorized access and alteration during transmission.

4. Log Files

Each time our website is accessed, data and information are automatically collected from the computer system of the accessing computer.

This includes the following data:

  2. The user's operating system
  3. The user's IP address
  4. Date and time of access
  5. Hostname of the accessing computer
  6. Referrer URL (i.e., the address of the website from which the user accessed our site).

The purpose of this processing is to analyze error conditions. This data is analyzed and evaluated exclusively on an event-driven basis, i.e., in the event of malfunctions or unexplained load behavior of the website. The data is not evaluated for marketing purposes.

The collection of data for the provision of the website and the storage of data in log files is essential for the operation of the website.

The legal basis for this processing is Art. 6 (1) (f) GDPR, as it is in our legitimate interest to offer you a stable and functional website and to protect it from unauthorized access.

5. Storage Duration

The personal data of the data subject will be deleted or blocked as soon as the purpose for its storage no longer applies. Data may be stored for longer periods if provided for by European or national legislators in EU regulations, laws, or other provisions to which we, as the controller, are subject.

If bank details are collected for a refund in the course of a package cancellation, they will be stored for 10 days to process the refund. If the customer provides a new e-mail address for the cancellation confirmation, it will be deleted after 6 months at the latest. The remaining customer data will be deleted six years after the cancellation. This excludes documents that are subject to longer statutory retention periods (see below).

IP addresses are stored for a maximum period of 31 days.

Log data is deleted after two weeks, with the collected IP addresses being anonymized after just seven days.

Furthermore, retention periods may exist under tax and commercial law in accordance with the German Commercial Code (HGB) and the German Tax Code (AO), ranging from six (§ 146 AO) to ten years (§ 257 HGB). The legal basis for this storage is Art. 6 (1) (c) GDPR in conjunction with the respective statutory regulation. If necessary, your data will be blocked for ongoing operations during this period, provided there is no other purpose for processing.

6. Your Rights as a Data Subject

You have the right to assert the following rights regarding your personal data at any time, free of charge:

  • Right of access
  • Right to rectification or erasure
  • Right to restriction of processing
  • Right to object to processing
  • Right to data portability

You also have the right to lodge a complaint with a data protection supervisory authority about our processing of your personal data.

7. Revocation of Consent or Objection to Processing

If you have given your consent to the processing of your data, you can revoke it at any time. Such a revocation will affect the lawfulness of the processing of your personal data from the moment you express it to us.

Insofar as we base the processing of your personal data on a balancing of interests, you may object to the processing. This is the case if the processing is not necessary, in particular, for the performance of a contract with you, which we will outline in the subsequent description of the functions. When exercising such an objection, we ask you to explain the reasons why we should not process your personal data as we have done. In the event of a justified objection, we will examine the situation and will either cease or adapt the data processing or demonstrate our compelling legitimate grounds for continuing the processing.

8. Deletion of Personal Data

The data we process will be deleted in accordance with legal requirements as soon as the purpose of processing your data has ceased or it is no longer required for that purpose. Your data will also be deleted if the processing was based on your consent and you have revoked it.

It may be necessary to store your data for other legally permissible purposes, such as fulfilling a legal obligation, exercising legal claims, or for tax-related reasons. In these cases, your personal data will only be processed for these specific purposes.

9. Customer Data Processing

As part of customer data processing, we collect and store necessary information such as first and last name, address, e-mail address, telephone/fax number, ordered goods/services, customer inquiries, and the date of the inquiry.

We process this data (with the exception of your IP address) for the fulfillment and execution of contracts with you (including payment processing), for customer inquiries, and for our own advertising purposes in accordance with applicable data protection regulations.

The legal basis for processing your customer data is Art. 6 (1) (b), (c), and (f) GDPR. Your data will be deleted once the purpose no longer applies, provided there are no conflicting statutory retention periods (especially from the German Tax and Commercial Codes).

10. Payment Processing with Stripe Inc.

We partner with Stripe Inc. (510 Townsend Street, San Francisco, CA 94103, USA) for payment processing on our platform. To carry out and manage payment transactions, it is necessary to transmit personal data such as name, e-mail address, payment information, and other data required for payment processing to Stripe Inc. This data transfer to the USA is absolutely essential for the functionality of the website and is based on our legitimate interest in secure and efficient payment processing, in accordance with Art. 6 (1) (f) GDPR.
